Welcome to MockTear. These Terms of Service ("Terms") govern your access to and use of the MockTear web application (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

MockTear provides an AI-powered tool that generates 3D-style smartphone mockups from screenshots you upload. The output is produced by third-party AI models (currently Google's Gemini API) and may vary in quality and accuracy.

2. Eligibility and Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account and password.
• You are responsible for all activity that occurs under your account.

3. Credits and Payments

• New accounts receive an initial allotment of free credits. Each generation consumes one credit.
• Additional credits may be purchased through paid plans (currently "Starter" and "Pro"), processed by Polar.sh.
• Credits are non-refundable except where required by law. Unused credits do not have monetary value and cannot be exchanged for cash.
• Prices and credit amounts may change. Changes apply to future purchases and renewals only; you will be notified before a price change takes effect on a recurring plan.
• Subscriptions and renewal: if your plan is recurring, it will automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date.
• Cancellation: you can cancel a subscription at any time through the customer portal provided by our payment processor (Polar.sh) or by contacting us. Cancellation stops future renewals; access and any remaining credits continue through the end of the paid period.
• Billing disputes: if you believe you were charged in error, contact us within 30 days of the charge.

4. Acceptable Use

You agree not to use the Service to:

• Upload content that infringes intellectual property, privacy, or other rights of third parties.
• Generate content that is illegal, harmful, harassing, deceptive, or sexually explicit involving minors.
• Reverse engineer, scrape, or attempt to bypass authentication, rate limits, or credit checks.
• Resell or redistribute the Service without our written permission.

5. Your Content

You retain ownership of the screenshots and prompts you upload ("Your Content"). By uploading, you grant us a limited license to process, store, and transmit Your Content to operate the Service (including sending it to the AI provider for generation and storing the resulting images in your account history).

6. Generated Mockups

Subject to your compliance with these Terms, you may use the mockups generated for you for personal and commercial purposes (e.g., App Store listings, marketing materials). You are responsible for ensuring that any underlying screenshots and final use comply with applicable laws and platform policies.

7. AI Output Disclaimer

The Service relies on third-party AI models. Output may be inaccurate, low quality, or unexpected, and is not guaranteed to be unique. You are responsible for reviewing all output before using it.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or use the Service in a way that may harm us or other users. You may stop using the Service at any time.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, MockTear and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
